Illinois legalized medical marijuana in 2013 under the Compassionate Use of Medical Cannabis Pilot Program Act. The state also has an industrial hemp pilot program. In 2018, the state passed legislation that officially legalized the sale and use of CBD oil with 0.3% THC or less (SB 2772).

Prior to January 2020, Illinois’ laws on marijuana were more lenient than other states (possession of 10 grams was just a Civil Violation). However, in May 2019, Illinois state legislators passed the Cannabis Regulation and Tax Act (Illinois House Bill 1438). 

The passage of HB1438 made Illinois the first state in the U.S. to legalize the recreational sale and possession of marijuana by an act of state legislature as opposed to a voter ballot initiative. It also made Illinois the eleventh legal recreational marijuana state on January 1, 2020. As a result, all forms of CBD are now legal in the state.
